Terms of Service

1. Agreement

These terms govern your use of the Nubixly website and any CRM service we provide to you ("the Service"). By creating an account or using the Service you agree to them.

2. The service

Nubixly provides custom CRM development, hosting and support. The specific scope, deliverables and fees for your project are set out in the written proposal or order form agreed between us, which forms part of these terms.

3. Accounts

You are responsible for the accuracy of the information you provide, for keeping your credentials secure, and for the activity of users you invite into your workspace. Tell us promptly if you believe an account has been compromised.

4. Acceptable use

You agree not to use the Service to store or transmit unlawful material, to attempt to gain unauthorised access to our systems or those of other customers, or to interfere with the operation of the Service.

5. Your data

You retain all rights in the data you put into the Service. We process it only to provide and support the Service, as described in our Privacy Policy and Data Processing Agreement. You may export your data at any time.

6. Fees

Fees, billing frequency and payment terms are those stated in your agreed proposal. Unless stated otherwise, fees are exclusive of applicable taxes.

7. Availability

We work to keep the Service available and backed up, but we do not guarantee uninterrupted operation unless a service level agreement has been agreed in writing. Planned maintenance is notified in advance where practical.

8. Intellectual property

We retain ownership of our own tooling, templates and pre-existing materials. Custom configuration and deliverables produced specifically for you are licensed to you as set out in your proposal.

9. Termination

Either party may terminate in accordance with the notice period in the agreed proposal. On termination we will make your data available for export for a reasonable period before deletion.

10. Liability

Nothing in these terms excludes liability that cannot lawfully be excluded. Subject to that, our aggregate liability is limited to the fees paid by you in the twelve months preceding the claim.

11. Changes

We may update these terms from time to time. Material changes will be notified to you in advance.
